김홍상 채광석 2018-11-15T09:35:19Z 2018-11-21T01:20:50Z 2010 C2010-21 http://repository.krei.re.kr/handle/2018.oak/19422 1996년 농지법이 시행된 이후 여러 차례 개정을 통해서 농지법령에 따라 농지 관련 사무의 일부를 지방자치단체에 위임하여 처리하고 있다. 그런데 최근 지방분권촉진위원회는 기관위임사무 문제를 제기하면서, 기관위임사무를 폐지하고 자치사무화하거나 국가사무로 환원하는 등의 제도개선을 요구하고 있다. 이에 따라 농지 관련 사무의 기관위임사무 폐지시 효율적인 농지관리 방안을 마련하는 것이 시급하다. 이미 일본은 2000년 기관위임사무를 폐지하고, 이를 지방자치단체의 자치사무와 법정수탁사무, 국가사무 등으로 재편하였다. 이 연구는 지방분권 촉진 등 환경변화에 대응하여, 농지관리 업무의 추진체계를 재정립하여 장기적으로 농업성장과 지역활성화에 도움이 될 수 있도록 농지관리 사무의 효율적 처리 방안을 모색하고자 하였다. Since for the most part, local government's affairs were functions given from government named "delegated affair", local government performed the limited function as lower-administration of the central government. Recently decentralization has been applied on a large scale at all levels of government in Korea. As a result the current system(farmland administrative affairs) to preserve the farmland has several limitations due to such factors. One of factors is the ambiguity of the term "necessary acreage for farmland" to secure food supply, etc. Successful decentralization of farmland administrative affairs requires re-adjusting their functions between the central government and the local one. Furthermore, the scope and process of decentralization can be altered to the way that the administrative functions of central and local government are established. Recognizing the issues mentioned above, the purpose of this study is to seek ways to ensure the effective treatment of farmland administrative affairs under decentralization. For this purpose this study is designed in following frame. Chapter 1, introduction, including the purpose, scope, and methodology of study; Chapter 2, the construction and operation of farmland administrative affairs; Chapter 3, Characteristics of farmland administrative affairs and problems on the distribution among administrative tiers; Chapter 4, A case of Japan: bench- marking realities and re-adjustment; Chapter 5, suggestions on principles, criteria, and the procedure to adjust farmland administrative affairs.
