유찬희 승준호 김종인 김현정 2023-02-20T16:40:06Z 2023-02-20T16:40:06Z 2022-10-30 979-11-6149-571-2 R952 https://repository.krei.re.kr/handle/2018.oak/29586 농업경영체 등록제는 농업 전반의 특징을 파악하고 이에 맞추어 정책을 설계할 수 있도록 정보를 제공하는 핵심 기능을 담당하고 있다. 최근 여건이 변하면서 농업인을 식별하는 수단으로서 중요성 역시 커지고 있다. 그럼에도 현행 농업경영체 등록제는 여러 가지 한계를 지니고 있다. 대표적으로 법적 정의 자체가 경영체로서 특성을 담지 못하고 있고, 운용 측면에서도 농업인과 정책 대상이 아닌 자를 구분하는 데 한계를 드러내고 있다. 뿐만 아니라 다양한 방식으로 농업 경영에 참여하는 이들의 역할을 인정하고 이들을 농업인으로 인정할지를 판단하는 기준으로서 기능도 강화해야 한다. 따라서 현재 농업경영체의 정의가 현실에 부합하는지, 그렇지 않다면 현실을 보다 잘 반영할 수 있게끔 농업경영체의 (법적) 정의와 범위를 어떻게 개편해야 할지를 검토해야 한다. 이처럼 농업경영체 등록제의 역할과 목적을 재정립한 뒤, 제도 개선 방안을 마련해야 하는 것이다. 본 연구에서는 농업경영체 등록제 시행 이후 드러난 문제점을 정리하고 운용과 법률 측면에서 개선 방향을 제시하고자 하였다. 농업경영체 등록제의 목적과 역할을 다시 설정하고 농업경영체와 농업 및 농업인의 개념을 재정립하였다. 농업경영체 등록제의 역할은 농업경영체가 필요한 (최소한의) 정보를 제공하도록 제도화하는 것으로 제안하였고 현재 시점에서 중요한 목적은 정책대상인 농업인과 농업경영체를 식별하는 수단으로서 기능하는 것으로 설정하였다. 본 연구를 수행하기 위해서 선행연구 검토, 설문 조사, 면담 조사, 전문가 협의회 등의 방법을 활용하였다. 농업경영체법을 비롯해 농업경영체 등록제와 관련된 법령도 검토하였고, 법률 전문가 자문을 받아 대안을 제시할 때 활용하였다. 농업인 600명과 전문가 및 공무원 100명을 대상으로 설문 조사를 실시하였고 농업인 및 농업인 단체, 학계전문가, 농업경영체등록업무를 맡고 있는 국립농산물품질관리원 관계자와 면담 또는 협의회를 실시하여 연구에 반영하였다. Background of Research ○The agricultural holding registration system was originally introduced to support customized agricultural policy. However, with changing circumstances, the importance of the system as a means of identifying ‘actual‘ farmers has been increasing. Nevertheless, the current system has several limitations. First, the legal definition itself of an agricultural holding does not contain the characteristics of a business entity, and the application of the system has shown limits in classifying farmers and people who are not policy targets. Moreover, it is necessary to strengthen the function of the system as standards for recognizing the roles of (family) workers who participate in agricultural management in various ways and for judging whether to acknowledge these people as farmers. ○In this regard, it is needed to review if the present definition of an agricultural holding accords with reality, and if not, how to reform the (legal) definition and scope of an agricultural holding in order to better reflect reality. It is required to reestablish the roles and purpose of the agricultural holding registration system and come up with measures to improve it. Research Method ○This study conducted a literature review, a survey, interviews, and meetings with experts. We reviewed the Agricultural Holdings Act and legislations related to the agricultural holding registration system, and utilized legal experts’ advice to present alternatives. ○The targets of the survey were 600 farmers and 100 experts and public officials. The survey results were used to derive the respondents’ perceptions of the system and tasks for improving it, and to analyze the scope of agriculture and farmers, the standards for identifying farmers, and whether to acknowledge workers as farmers according to their occupational status. We had 15 interviews or meetings with farmers and farmers’ groups, experts in academia, and a person in charge of agricultural holding registration at the National Agricultural Products Quality Management Service (NAQS) for in-depth discussions. We requested two legal experts to advise on related legislations and reflected the results in the study.
